J&J Vaginal Mesh Faces FDA Panel as Number of Lawsuits Rise

 

U.S. regulators failed the public by not requiring extensive testing before allowing Johnson & Johnson AND BARD to sell this type of surgical mesh. The U.S. Food and Drug Administration used an abbreviated process known as 510(k) to clear the mesh, which supports weakened muscles that can’t hold a woman’s pelvic organs in place. Patients who have had this mesh surgically implanted have endured pain so intense that they are unable to work, sleep through the night or have normal sexual relations.

The FDA did issue a warning on July 13th of a rise in injuries related to the mesh, and it said last month the devices should be reclassified from moderate risk to high risk, a change that would typically require new clinical data.

The New Jersey No Fault Act provides that every standard automobile liability insurance policy shall contain personal injury protection (PIP) benefits that include the payment of medical expenses in an amount not to exceed $250,000 per person per accident. N.J.S.A. 39:6A-4. In addition, the Act requires the Commissioner of Banking and Insurance to promulgate medical fee schedules for the reimbursement of health care providers for services and equipment.

Hearings would determine if Doctors are Policing Themselves

Associated PressAt first glance, a consumer watchdog group's data seem to indicate New Jersey's Board of Medical Examiners isn't taking action against bad doctors. A legislative hearing would determine if that's so.

A consumer watchdog group issued a report recently that says 57 percent of the state’s doctors whose hospitals suspended or revoked their privileges between 1990 and 2009 were not disciplined by the Board of Medical Examiners.

Here’s why this is a problem: If those doctors had their privileges removed because they were dangerous, they were still free — without intervention by the board — to harm patients in private practice.

What You Need to Know About Breast Cancer
