DEFENDANT VERDICT/SETTLEMENT
Mangual v. Berezinksy Eric Kahn represented the plaintiffs: a man and woman struck by a livery vehicle as they stood beside their disabled car on the shoulder of Interstate 280. They settled with the defendant driver for his policy limit of $200.000 and continued to pursue their claim against the Essex Surgery Center LLC of Hackensack, who had hired the driver to transport patients. The court granted the plaintiffs’ motion for summary judgment on the issue of agency. Essex Surgery Center appealed and the Appellate Division, in a published July 2012 decision, affirmed liability but said agency was a jury question. Following mediation, Essex Surgery Center settled on Dec. 26, 2012, for $2.15 million, bringing the total recovery to $2.35 million.
MICHAELS INDUSTRIAL Eric Kahn obtained a $950,000 settlement against the operator of a dump truck. Defendant-Michaels Industrial.
GIBSON Jack Wurgaft obtained a $1.7 million settlement in resolution of a Somerset County suit over a crash that killed a young girl and her grandmother.
DISASTER RESORATION SERVICES INC. Jack Wurgaft obtained a $700,000 settlement for an auto accident that left a passenger permanently disabled.
ARMSTRONG Eric Kahn obtained a $250,000 settlement for a 19 year old man who was a passenger in a one car accident and who suffered spinal cord injuries after the operator of the automobile lost control and struck a tree. This settlement represented the full amount of the Defendant's policy limits.
UNITED STATES POSTAL SERVICE In a lawsuit filed on behalf of a pedestrian who was struck by a postal truck, Eric Kahn negotiated a $175,000 settlement in the United States Federal Court with the United States Post Office proving that the operator of the postal truck did not exercise reasonable care while operating his postal truck on a day when it was raining and foggy outside.
MACHETTE In a lawsuit filed on behalf of an 84 year old woman, Eric Kahn obtained a $250,000 settlement proving that the Defendant should have seen the pedestrian who was walking on the sidewalk when he was backing out of his driveway. As a result of striking the pedestrian, she was knocked to the ground and suffered a severe left leg fracture.
NASCIMENTO Jack Wurgaft obtained a $2.6 million verdict on behalf of the family of a man killed in a head-on collision with a trucker proving that the trucker had exceeded the Interstate Commerce Commission (ICC) limits for hours of driving.
COHEN In a lawsuit on behalf of a pedestrian who lost a leg when struck by a car, Ken Javerbaum negotiated a $1 million settlement, proving that the driver of the car was en route in the course of her employment requiring the employer's insurance company to make its coverage available to her.
NEW JERSEY TRANSIT In a lawsuit by a bus passenger against New Jersey Bus Operations, Jack Wurgaft obtained a $750,000 jury verdict for a knee injury that occurred when the passenger fell in a bus that began moving before the passenger had a chance to be seated.
GREYHOUND LINES In a lawsuit against the operator of a bus, Bob Hicks obtained a $1.5 million settlement on behalf of the estate of a single mother of two children. The proceeds of the settlement were used to establish an annuity trust that will pay tens of millions of dollars over the lives of the two children ensuring payment of educational expenses, housing and other needs.
M.D. TRUCKING COMPANY In a lawsuit against a trucking company and its driver, Bob Hicks obtained a judgment of more than $5.2 million on behalf of the plaintiff who suffered brain damage as a result of an accident with the truck.
WERNER ENTERPRISES In a lawsuit against the owner of a tractor trailer, Ken Javerbaum obtained a $950,000 jury verdict on behalf of a 57-year-old client for which he had previously collected $250,000 by way of settlement a year earlier. He established that the injuries had been aggravated.
DOMINGO RODRIGUEZ-SALAZAR Eric Kahn obtained a $250,000 jury verdict on behalf of a passenger in an automobile accident who upon being struck from behind by the defendant, suffered injuries including a disc protrusion at L4-5 with the presence of L5 radiculopathy confirmed by an EMG.
