The civil jury system is a trademark of democracy and an important defense of freedom. Buried in the fine print of consumer contracts are waivers of the consumer’s right to trial by jury and replacing it with arbitration where a single individual decides the dispute with no right of appeal. Adding insult to injury, many times the selection of the arbitrator is determined solely by the corporation. The intent of forced arbitration is simple, to deny victims from just compensation and to shield corporations from accountability.

Other attempts by corporations to deprive consumers of their right to trial by jury are waiver clauses in the fine print in their contracts where the consumer gives up his or her right to seek compensation for injuries caused by the corporation’s negligence. This has become a large issue with tragic injuries at “trampoline parks” all over the country. Despite the dangers, these businesses are attempting to shield themselves of all responsibility by utilizing waivers signed by customers looking to enjoy themselves at the park. One of the building blocks of this “American Experiment” is responsibility, something that forced arbitration and waivers are utilized to destroy.
